Florida Probate Explained: What You Need to Know

When a loved one passes away, their estate often goes through probate, a court-supervised process for distributing assets and settling debts. If you are facing probate in Florida, understanding how it works can help you navigate the process with confidence and minimize stress. As an experienced Florida elder law attorney, I am here to explain the basics of probate, its different types, and how proper estate planning can help your family avoid unnecessary delays and expenses.

What Is Probate in Florida?

Probate is the legal process of administering a deceased person’s estate, ensuring that assets are distributed according to their will or, if no will exists, according to Florida’s intestacy laws. The probate court oversees this process to ensure that debts, taxes, and final expenses are paid before beneficiaries receive their inheritance.

In Florida, probate typically applies to assets solely owned by the decedent that do not have a named beneficiary designation (such as a life insurance policy or a payable-on-death bank account).

Types of Probate in Florida

Florida offers two primary probate processes:

1. Formal Administration

  • Used for larger estates exceeding $75,000 in probate assets
  • Requires court oversight, creditor notifications, and a personal representative (executor)
  • Can take six months to a year or longer to complete

2. Summary Administration

  • A faster and less expensive option for estates valued under $75,000 or when the decedent has been deceased for over two years
  • Typically does not require appointing a personal representative
  • Often completed in just a few months

For small estates with no real property, Disposition of Personal Property Without Administration may also be an option.

How to Avoid Probate in Florida

While probate can be time-consuming and costly, proper estate planning can help you avoid it altogether. Here are some effective strategies:
✔ Create a Revocable Living Trust to transfer assets outside of probate
✔ Add Beneficiary Designations to financial accounts and life insurance policies
✔ Establish Joint Ownership for real estate and bank accounts
✔ Gift Assets during your lifetime to reduce the probate estate
